Woman Sentenced to Jail for Reckless Manslaughter

A woman has been sentenced to jail for 12 years convicted of reckless manslaughter of a five year old girl.

The accident happened in January 2014 in Bibb Country when 33 year old Kathy Jones of Bessemer was driving a 1995 Chevrolet Blazer on Hopewell Church Road north of Centreville. The vehicle left the road, hit an embankment and overturned. Six people were hurt and 5 year old Isabel “Izzy” Parks of West Blockton was killed. Jones was allegedly on methamphetamine at the time of the accident, no one was wearing a seat belt and one of the children was in Jones’ lap at the time of the accident.

Isabel’s parents, David and Danielle Parks, now of McCalla, were each indicted on one count of criminally negligent homicide and four counts of aggravated child abuse and their trial will be held in June this year.

Jones, pleaded guilty to manslaughter under a plea deal with the district attorney’s office rather than going to trial on a murder charge.

Who Does Not Wear a Seat Belt?

Millions of Americans are not protected from injury because they aren’t wearing their seat belts on every trip and this leads to over two million people a year being treated in emergency departments for injuries following a motor vehicle accident. This costs around $70 billion in medical bills and lost time at work.

Around one in seven Americans decides not to wear a seat belt which increase their chance of injury or death by up to 50%. Those least likely to wear seat belts are young adults, aged 18 to 34 and men are 10% less likely to buckle up than women. Those living in rural areas are also less likely to wear a seat belt than those in urban areas.

Lives can be saved if you wear a seat belt and serious injury can be prevented. The most effective way to prevent injury and death from a road traffic accident is to use a seat belt on every journey.

How to Pass the Vehicle in Front Safely

Following behind a slow moving vehicle can surely be frustrating, but needing to pass the vehicle in front safely is of paramount importance.

Generally speaking, in order to pass safely you need to be travelling at least 15mph faster than the car you are passing and this is even more important when there is oncoming traffic. The best circumstances to pass another vehicle are a long flat clear stretch of road. Remember that even if you are overtaking a motorcycle you should still give the motorcycle the full lane width as for other vehicles, never move in to the same lane even if the motorcycle is travelling to one side.

You should not exceed the speed limit in order to pass another vehicle and should only change lanes to keep away from hazards, doing so with caution. If you see an oncoming vehicle or an obstruction you should brake and fall back behind the vehicle you were going to overtake until it is safe to attempt the maneuver again. Under no circumstances try and “beat” an oncoming vehicle or your may find yourself in a very serious collision.

In all circumstances stay calm, if it is not safe to pass, or the car in front is travelling so slow you can’t get enough speed up to pass safety you should wait or resign yourself to not passing.

Young Mother Lost Her Life in Crash With 18 Wheeler

On Tuesday October 20, a young mother lost her life in a crash with an 18 wheeler.

According to Alabama State Troopers the accident happened at approximately 8.15 a.m. at the intersection where Dunavant Valley Road and Narrows Parkway meet Highway 280.

They went on to say that 25 year old Jordan Alexa Mays, of Birmingham was killed when her 2008 Honda CR-V was in collision with a 18 wheeler. The impact caused both vehicles to be pushed hundreds of feet down an embankment coming to rest at the edge of a parking lot. Mays was pronounced dead at the scene of the accident. The force of the impact caused the left hand side of the SUV to be pushed over to the right side and amazingly Mays’ eight month old son, Maddoc, appears to have escaped serious injury and was taken to Children’s Hospital in Birmingham where his condition was described as good. The driver of the 18 wheeler, 39 year old Chassidy Renae Garner-James, of Holly Springs was taken to Grandview Medical Center as a precaution.

Witnesses commented that the volume of traffic and steep hills make this a dangerous area. Alabama State Troopers continue to investigate the cause of this tragic accident.

Truck Driver was Killed

On Thursday, September 24, a truck driver was killed.

According to police, 56 year old Charles Miller was hauling paper rolls from Tennessee to Mississippi in his 18 wheeler semi when he struck an overhead sign on the I 20/59 southbound at Arkadelphia Road, Birmingham.

Police say that it appears that Miller may have suddenly changed lanes due to reasons unknown which caused the 18 wheeler to strike the sign. The sign penetrated the cab of the semi and Miller was pronounced dead at the scene. An SUV and a small car were also involved in the incident with one person suffering minor injuries.

Miller who used to drive for the military before retiring was on his first trip for Jeff Chism LLC which is based in Columbus, Mississippi.

There have been many vehicle accidents at the same exit, including a fatality just as recently as August 2015 and another 18 wheeler crash in July 2015. In an attempt to trying and reduce the number of deadly crashes the Alabama Department of Transportation installed a concrete median barrier on 20/59 near the Arkadelphia Road exit last year.

Defective Vehicle Accidents

Defective vehicles are a common menace on our roads. As we all know from the news, many defects are not revealed until many years after a vehicle is produced. We can hope that the auto makers are improving the way they do business and will start issuing recalls as soon as they discover dangerous defects, but in the meantime, there really is no way to know how many defective vehicles are out there like ticking time bombs right now.

Compensation for Defective Vehicle Accidents

If your accident was caused by a defective vehicle, or if a defect caused your injuries to be worse in an accident caused by a negligent driver or defective roadway, you can seek compensation from one or more of the following:

  • Auto maker
  • Parts manufacturer
  • New or used car dealership
  • Rental company
  • Parts seller
  • Repair shop
  • Another company along the chain of distribution of the defective vehicle or part, such as the shipper

Types of Defects

Some defects, such as faulty tires or defective brakes, can cause an accident to occur. Defects that do not cause accidents, but cause injuries to be worse in the event of an accident are referred to as crashworthiness defects. Faulty seatbelts and poor roof crush resistance are examples of crashworthiness defects.

Defective airbags can cause an accident if they deploy when there has been no accident. They can cause injuries to be worse if they fail to deploy when there is an accident.

If you believe or know that a defective vehicle caused your accident or injuries please call the Greenville accident attorneys of Jackson & Tucker, P.C., at (866) 252-3535 or contact us online today to schedule your free consultation.
